The answer is that Miranda vs. Arizona was when Miranda didn't know his rights when he got arrested so they came up with Miranda rights so if people get arrested and can't afford a lawyer they can get one.

The fifth amendment is "protects a person against being compelled to be a witness against himself or herself in a criminal case."

Which means that can have rights when they get arrested!
